Agreement to these terms

These Terms of Use ("Terms") govern your use of the website at ionhospitality.com, including go.ionhospitality.com, and the free resources, forms, booking calendar and messages offered through it (together, the "Service"), operated by ION Hospitality LLC, 7 Rivington St, New York, NY 10002 ("ION Hospitality", "we", "us"). By using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service. If you use it for a business, you confirm you are authorized to act for that business.

The site and our services

ION Hospitality is a restaurant marketing and advertising agency. The Service describes our work (content creation, social media advertising, websites built on Tableify, and our private events system), offers free playbooks, guides and reports, and lets you book a discovery call. Any paid work we do for you is governed by a separate written agreement, which controls if it conflicts with these Terms.

Text messages

By giving us your mobile number on a form or when you book a call, you agree to receive texts from ION Hospitality about your request, including the playbooks and links you ask for, call confirmations and reminders, replies to your questions and occasional offers about our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of any purchase.

Free resources and results

Our playbooks, guides, reports, case studies and calls are for general educational and informational purposes. Results and case studies we share are not typical and are not a promise: every restaurant is different, and your results depend on your market, budget, execution, timing and team. Nothing on the Service is legal, tax or financial advice; check with a qualified professional before relying on it.

Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, deceptive or abusive
• Submit someone else's name, email or mobile number without their permission
• Send spam or automated submissions, or try to scrape, overload or interfere with the Service
• Upload malicious code, infringe anyone's rights, or impersonate others

Intellectual property

The Service and its content, including text, playbooks, photos, videos, logos and design, are owned by ION Hospitality or its licensors and protected by intellectual property laws. You may use them for your own restaurant's internal use. You may not copy, resell or republish them without our written permission. Other product names, logos and brands mentioned on the Service belong to their owners and are used for identification only.

Third party sites and tools

The Service links to and embeds tools run by others, such as the booking calendar and free report provided by Tableify and social media platforms. Your use of those tools is also subject to their own terms and privacy policies. We are not responsible for third party content, services or practices. This site is not part of, or endorsed by, Meta, Google or any social media platform.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error free or free of harmful components, or that any information on it is complete or current.

Limitation of liability

To the maximum extent permitted by law, ION Hospitality and its suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data, arising out of or related to the Service. Our total liability for any claim related to the Service is limited to the amount you paid us through the Service, or 100 US dollars if you have not paid us anything. Some states do not allow these limits, so they may not all apply to you.

Indemnification

You agree to indemnify and hold harmless ION Hospitality from any claims arising out of your use of the Service or your breach of these Terms.

Termination

We may suspend or end your access to the Service at any time if you breach these Terms or use the Service in a way that creates legal or operational risk for us or others.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. If you have a concern, please contact us first so we can try to resolve it informally. Any dispute that cannot be resolved that way will be heard in the state or federal courts located in New York County, New York.

General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it. We may update these Terms from time to time; the "Last updated" date at the top shows the latest changes, and using the Service after a change takes effect means you accept the updated Terms.
